This Privacy Policy describes the policies and procedures of WellApps, Inc. (“WellApps”, “we” or “us”) on the collection, use and disclosure of your information on www.WellApps.com (the “Site”) and the services, features, content or applications offered by WellApps (collectively with the Site, the “Services”). WellApps receives information about you from various sources, including: (i) if you register for the Site and the Services, through your user account with WellApps (your “Account”); (ii) your use of the Services generally; and (iii) from third party websites and services. When you use the Services, you are consenting to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy.

 

WellApps realizes that its Services can only work if we build trust with our patient communities. This Privacy Policy outlines the type of information WellApps collects from its members and how it is shared with other parties. We reserve the right to modify this policy at any time, and without prior notice, by posting amended terms on the Site. We encourage you to review this policy periodically for any updates.

WHAT KIND OF DATA WE COLLECT AND WHY

WellApps enables you to track your disease history online in order to monitor your symptoms and report more accurate data to your doctors, resulting in better diagnosis, treatment and recovery. In order to do so, WellApps creates an account specifically for you.

If you become a member of the Services, you will be asked to enter certain information. This data (“Profile Data”), is generally not personally identifiable to you, and may include some or all of the following:

* Condition/disease information, including diagnosis date, first symptom information, and family history
* Treatment regimens, including treatment start dates, stop dates, and dosages
* Symptoms experienced, including severity and duration
* Primary and secondary outcome scores over time
* Biographical information, including bio, gender, age (or birth date), location (city, state & country), and general notes.

In addition to your Profile Data, you will be asked to enter additional information that identifies you (“Personal Information”), such as your name and e-mail address. This personal information may be used to communicate with you, provide you with specific services you select, and send you e-mails about Service maintenance and updates.

You control and authorize who can gain access to your Account by use of your e-mail address and password. If you wish to grant your physician direct on-line or mobile access to your data, you must give the physician your email address, and you will receive a confirmation e-mail to opt in and confirm that this physician is authorized to see your Profile Data.

In addition, individual Profile Data, as well as collective real-time data of all of our patient members (“members”), may be used by clinicians, researchers and other medical professionals to improve treatment and diagnosis of chronic illness. In order to enable this functionality, we will create a second class of members comprised of health professionals, i.e., clinicians, researchers and physicians generally involved in treatment of the applicable conditions (the “Professional Members”). We will provide our Professional Members with aggregate or individual data, on a non-personally-identifiable basis, for research and commercial purposes. For example, we may look at scientific questions such as, "Do certain treatments work better for some types of people versus others?" We may report percentages of patients trying a particular treatment or experiencing a particular symptom. In addition to serving the individual needs of our members, WellApps may enable on-going research studies, which may be funded by non-profit or for-profit institutions and entities. Furthermore, we may provide an opt-in service to allow our future partners to communicate directly with you through our system.

In order to enable the aggregation of such data and enhance the Service’s effectiveness, it is up to our members to embrace the Service’s multiple purposes and use of the data you enter, i.e., the more complete your entries, the more valuable such collective data may be for the Professional Members.

WellApps will never rent, sell or share information that personally identifies you for marketing purposes.

We may also periodically ask you to complete short surveys. You are free to respond or not. Your participation in these surveys is not required, and your refusal to do so will not impact your experience on the Service. To create the best possible tools, research, and functionality for patients in general, we may also review your Personal Information internally as needed.

Even if you do not register on the Service, if you visit the online version of the Service, we may collect non-personal information about you through the use of cookies, a required component of the Services. A cookie is a small data file, which often includes an anonymous unique identifier, that is sent to your browser from a website 's computers and stored on your computer's hard drive. WellApps uses two types of cookies: Session Cookies, and Persistent Cookies. Session Cookies are temporary cookies that remain in the cookie file of your browser until you leave the Site. Session cookies do not store any personally identifying information, only a unique visitor ID number that we can use to customize the WellApps functionality for you. Persistent Cookies remain in the cookie file of your browser for much longer, even after you leave the Site or application. Persistent cookies do not store any personally identifying information, only preferences that should persist from visit to visit. In addition to facilitating the collection of information, we use cookies to monitor the number of people using the Services and links from the Services.

Some features of the Services allow you to provide post content, such comments, images and video. All content submitted by you to the Services may be retained by WellApps indefinitely, even after you terminate your account. We may continue to disclose such content to third parties in a manner that does not reveal Personal Information, as described in this Privacy Policy. Please also remember that if you choose to provide Personal Information using certain features of the Services, then that information is governed by the privacy settings of those particular features and may be publicly available. Individuals reading this information may use or disclose it to other individuals or entities without our control and without your knowledge. Therefore, we urge you to think carefully about including any specific information you may deem private in content that you create or submit through the Services.

WellApps automatically receives and records information from your web browser when you interact with the Services, including your IP address. Generally, the Services automatically collect usage information, such as the number and frequency of visitors to the Site. WellApps may use this data in aggregate form, that is, as a statistical measure, but not in a manner that would identify you personally. This type of aggregate data enables us and third parties authorized by us to figure out how often individuals use parts of the Services so that we can analyze and improve them. While we collect and store IP address information, that information is not made public and is not shared with third parties.

We employ and contract with people and other entities that perform certain tasks on our behalf and who are under our control (our “Agents”). We may need to share Personal Information with our Agents in order to provide products or services to you. Unless we tell you differently, our Agents do not have any right to use Personal Information or other information we share with them beyond what is necessary to assist us. You hereby consent to our sharing of Personal Information with our Agents.

In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the transferred business assets. Moreover, if WellApps, or substantially all of its assets, were acquired, or in the unlikely event that WellApps goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of WellApps may continue to use your Personal Information as set forth in this policy.

WellApps also reserves the right to access, read, preserve, and disclose any information as it reasonably believes is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce these Terms of Service, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of WellApps, its users and the public. This includes exchanging information with other companies and organizations for fraud protection and spam prevention.

International Users

WellApps makes no claims that information on the Services is appropriate or may be downloaded outside of the United States. Personal information that is submitted to this Site will be collected, processed, stored, disclosed and disposed of in accordance with applicable U.S. law and this Privacy Policy. If you are a non-U.S. user, you acknowledge and agree that WellApps may collect and use your information and disclose it to other entities outside your resident jurisdiction. In addition, such information may be stored on servers located outside your resident jurisdiction. U.S. law may not provide the degree of protection for Information that is available in other countries. By providing us with your information, you acknowledge that you consent to the transfer of such information outside your resident jurisdiction as detailed in our Privacy Policy. If you do not consent to such transfer, you may not use this Site.

SECURITY PROCEDURES AND OTHER SECURITY ISSUES

WellApps takes commercially reasonable technical precautions to help keep your data secure. We require both a personal username and a password in order to access one’s Personal Information, and we use firewalls to protect information held on our Services. Despite WellApps’ efforts to protect your Personal Information, there is always some risk that an unauthorized third party may find a way around our security systems or that transmissions of your information over the Internet or via your wireless carrier may be intercepted.

RISKS AND BENEFITS

While our goal is to help patients improve health outcomes, there are no certain benefits to using this Service. However, keeping track of personal well-being, treatments and symptoms has been shown to be helpful in improving overall health. In addition, the collection of real-time global symptom data aids research and contributes to progress towards more effective treatment of chronic illness. Of course, you are free to stop using the Services at any time.

HOW CAN I DELETE MY ACCOUNT?

Should you ever decide to delete your Account, you may do so by emailing support@wellapps.com. If you terminate your Account, any association between your Account and information stored by WellApps will no longer be accessible through your Account and you will no longer be able to use your Account. However, given the nature of sharing using WellApps, any public activity on your Account prior to deletion will remain stored on WellApps’ servers and will remain accessible to the public.

WHAT CHOICES DO I HAVE REGARDING MY INFORMATION?

  • You can use some of the features of the Services without registering, thereby limiting the type of information that we collect.

  • You can always opt not to disclose certain information to WellApps, even though it may be needed to take advantage of some WellApps features.

  • You can delete your Account. Please note that WellApps will need to verify that you have the authority to delete the Account, and activity generated prior to deletion will remain stored by WellApps and may be publicly accessible.

WHAT HAPPENS WHEN THERE ARE CHANGES TO THIS PRIVACY POLICY?

WellApps may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make changes in the way we collect or use information, we will notify you by posting an announcement on the Services or sending you an email. A user is bound by any changes to the Privacy Policy when he or she uses the Services after he or she has been notified about such changes through one of the above methods.
